>> you have a right to a jury trial. you have a right to be present at trial, however the trial will proceed in your absence. if you fail to appear or violate a condition of the bond. hello everybody i'm betty nguyen we are following breaking news an air asia plane has disappeared after taking off from indonesia on its way to singapore.
2:01 am
both country versus launched a search and rescue operation but no word yet on the plane's whereabouts. air asia said the crew asked for a change in flight path. they wanted to go from 32,000 feet to 38,000 feet to avoid rough weather in their path. here's a live picture where a help center is set up for families. there were 162 people on board, 7 crew members and 155 passengers. now most of them were indonesians with three south koreans, one from singapore and one from malaysia. 16 are children and at least one of them an infant. air asia is a regional low cost carrier with presence in several southeast asian countries. president obama has been briefed and the ntsb is monitoring the search and stands ready to help if needed. joining me on the phone is anthony roman. he's an faa licensed commercial
2:02 am
pilot and licensed flight instructor. >> good morning. >> based on what we know let's look at the possibilities. this plane has been missing around 11 hours right now. that's not a good sign. >> well, you have to understand there is severe weather in the region. the season brings in the northeast monsoonal rains which are tremendous thunderstorms that can reach up to 60,000 feet. this results in gale force to almost low hurricane force winds on the surface and the surface conditions of the sea must be rather severe so it will be a difficult search for this particular aircraft both for surface vessel and the c-130. >> if the weather was that bad, why would this plane take off?
2:03 am
>> well, the aircraft and pilots in this particular region are well equipped and well trained and experienced in this kind of monsoonal fly. so it's not unusual for them to be operating. it is not unsafe except in these particular circumstances we looked at the radar plot and it appeared that a good portion of the java sea was blocked by level five thunderstorms. those are the most thunderstorms known. these are the monster storms that reach up to 60,000 feet. we saw some aircraft passing on the north, northeast side of the storm but these storms can grow and shift very quickly. the area that was very clear that could have been safely passed was to the south, southwest of the flight route. whether or not the deviation requested by the asia airline
2:04 am
pilots was to the south, southwest is unknown at this time. >> that's going to be very key because this plane lost contact with air control 42 minutes after take off. the pilot though before then did request a deviated route because of weather. is there any chance that perhaps this pilot was able to put this plane down safely on the ground and we haven't heard from it yet? >> i mean, there are very many possibilities but in this particular circumstance i would say that that is a remote possibility simply because we believe there would be some communication from the pilot and from the passengers at this time. >> let's look at the search area. it's over the java sea and the fact that it was 42 minutes after take off that they lost contact does this help narrow the search? >> it does. it does not compare at all to the mh 370 disaster.
2:05 am
here we had communication with the pilot until shortly before the aircraft was presumed lost. we know it's exact flight path. they requested a specific deviation so they know more or less the deviation that the pilot was going to take. it should have been within radar contact of multiple stations including military radar during that time so it will be a much smaller search zone for this particular airplane. >> you mentioned malaysia airline's flight 370 which took off on march 8th of this year. it's still not been found. there was another malaysian airliner that was involved in basically a crash in ukraine and then now there's this. it's not been a goodyear for malaysian owned airlines. they're operated by different companies but is there any comparison at all? >> there really isn't any
2:06 am
comparison. the weather in the case of mh-370 was relatively benign along with the entire route. that aircraft turned and made 180 degree turn back toward malaysia for no particular reason. communication was lost. no deviation was requested and it proceeded a long, very long route to the southern indian ocean. this was an aircraft on its flight plan proceeding on course, requested the deviation. there was terrible weather between themselves and the destination and was within radar contact or should have been within radar contact for the entire flight. >> if there was bad weather in the area and the pilots requested a deviation would we hear a distress call? that's not been reported as of yet. >> not necessarily.
2:07 am
the mantra of all aviators professional or private from the first lessons they begin to take is to aviate first and navigate second and communicate third. in other words get control of the aircraft if you're having any kind of emergency, any kind of weather emergency, keep control and get control of that aircraft. second, navigate that aircraft to a safe destination including any alternate as a result of any bad weather or mechanical difficulties or combination there of and communicate your circumstances to the air traffic controller and make any requests that you need. >> air asia put out in a statement the number of flying hours that the captain had. it was 6100. the first officer 2200 flying hours. in your opinion are those experienced pilots. >> they were experienced and
2:08 am
that is enough for a captain to pilot an aircraft from this class and category. i do know many captain with more hours than that. 10, 15, 20,000 hours but certainly he has the training and experience to fly this kind of aircraft and these particular pilots are accustomed to the monsoonal zone and northeast monsoonal season. you have a wonderful aircraft and probably a well trained crew and experienced crew. i don't see any factors based on the information we have now. >> all right well the question still remains where is this plane. thank you so much for joining us. you have been up with us throughout the night giving your expertise and we do appreciate it. we'll continue to follow this story. the missing air asia flight with 162 people on board. stay here with msnbc for the latest reports.

day. during the past five years stafford had 8 stays at the jail for convictions including shoplifting, stress passing and petty larceny. he is currently charged with a property crime for which he has pled not guilty. >> see that's what i'm talking about there but i'm going to get charged with assault and battery. get out my face. >> he likes to be confrontational from time to time. he plays around. anything to draw attention to himself. he likes an audience so that makes it difficult. it slows it down from doing our day-to-day work. >> stop resisting. i've got to take the cuffs off. >> he can be on and off so it's a daily thing with him. so a lot of times if you just talk to him and if you can relate to him, relate to him and he'll calm down a little bit.
2:16 am
>> he claimed he had mental health issues. usually someone with mental health issues don't advise us that they have mental health issues. he was cleared for general population. >> when housed in general population he was cited nine times for misconduct. the most recent was caught on surveillance cameras. >> he pushes the limit. he pulls the chairs just to get a rise out of the officers inside the unit. aggravate them and make their day worse so they're trying to let him know they're not going to put up with it but it doesn't bother thelda. >> moments later stafford raised the stakes. >> i was standing against the wall. my hands were crossed. >> he was on duty in stafford's

unit. >> he swung on me and i grabbed him and brought him down to the ground. >> i just saw the guy swinging on me with something in his hand. i didn't know if it was stafford or somebody else. it wasn't until i got him on the ground until i realized it was stafford. he said you know i'm just joking. >> he has a soda juice in front of their bottle. it could be juice or urine or anything. >> there was no way possible that i could possibly try to harm him. >> did you have a bottle in your hand? >> my juice or whatever was in it. it's like this bottle right here. >> he's young, he's immature. it's a child. if you understand that dewayne is a child, immature, that's what he's looking for is that negative attention. >> stafford was given 30 days in

segregation for the incident. but all segregation inmates are routinely reviewed for a possibility of an earlier return to population. >> when he does get pulled quickly and you give them a charge of 30 days but once you're in there you're reducing time to get people moved out and back in general population. staff say every now and then they run into an inmate that seems to prefer segregation. >> how's your behavior. >> horrible. >> are you saying that because you want to remain in 1-a. >> this could have been reviewed the last time i got charged. >> after several minutes of questions and answers officers decide stafford will remain in segregation but before he leaves sergeant gains raises a new concern. >> ask them to get you some fingernail clippers. i want them nails clipped.
2:19 am
they look like weapons. >> you want my nails clipped. >> look at your nails. you talk about mine. you should clip your own nails. what is wrong with you. >> like i said, clip them. >> have a good day mr. stafford. >> he can use those as a weapon and he can slice anything because those nails were very long. i don't know what his mind is doing. i don't know if he's crazy or not. >> coming up. >> stafford i'm going to give you the clippers for you to cut your nails within a quarter of an inch. >> dewayne stafford is offered a final chance to cut his nails or have the special operations group do it for him and violence breaks out in one of the female housing units.

behind the walls of the detention center in charleston, south carolina. her favorite day of the week is thursday. >> i've been waiting for you since like 9:00 this morning. >> i can see that. >> that's when inmates receive snacks, toiletries and other items they ordered. >> pretty much the only thing we wait for during the week. it's the most exciting thing between that and if you get visits. other than that there's really nothing to look forward to. they're my favorite and then the big bags of potato chips last awhile. this is like 50 and you can order up to $100 but other than that, my grandma puts $50 on there every other week so this will last me about 20 weeks and then i actually got the girl down the way who was with me the other day i got her some canteens so i'm going to go give these to her. >> she shares her snacks with jessica roberts.

it i'll do it. and it was awesome. it's really bad to say that but it was. >> now she faces more serious consequences than ever before. she is charged with first degree burglary and can face years in prison if found guilty. police discovered her phone outside a home where she says she tried to steal a tv order to buy drugs. she told investigators she acted alone but that might not be the truth. >> that's my story. that's the story of what happened. that's what they have on the paper. i can't -- i mean, i would say what really happened but that would make me a snitch too. so that's my story. >> even if telling the truth could help your case. >> yeah. even if telling the truth could help my case. >> that's a very big price to pay. >> i know. >> or it could be a very big
2:25 am
price to pay. >> but the other person could suffer a lot more than i could. >> you're willing to suffer for both of you. >> yes. i'll do that just fine. >> everybody knows it. my whole family knows i steal. i'm a criminal. >> at the time of her arrest she was living with her boyfriend josh gore but said he had nothing to do with the burglary. >> the officer wrote samantha is extremely addiment that mr. gore was at home asleep while she stole his mazda, went to the house, attempted to go through a window in the garage. like, yeah. so she did that. >> i love him to death. i'm hoping and i pray that me and him can get it together because i need him. he's like my road to everything, you know? i'm hoping we can figure this

hello everybody i'm betty nguyen. an air asia plane with 162 people on board is still missing at this hour after losing contact with ground control after take off. they were in route from indonesia to singapore when it lost contact just after requesting permission to fly higher than usual to avoid bad weather. air asia has set up an area for passenger families at both airports. we'll continue to bring you the latest developments in the story. now it's back to our regular programming.
2:31 am
>> due to mature subject matter viewer discretion is advised. inmates with major rule violations are segregated in single person cells 23 hours per day inside unit a1a. >> all of it effects individuals differently. some people like to be by themselves and they function better that way. others, they are by themselves a few hours would drive them crazy literally but overall i think there should be something and there is something in place for consequences of your actions and it's not like it's a secret. they get an inmate handbook. they know the regulations. from childhood you were taught what's right and wrong. respond to authority
2:32 am
appropriately and do what you're supposed to do. we're not asking anything more than that. >> today officer sheppard must deal with one inmate many believe relishes disciplinary segregation. >> he is currently housed in the segregation unit for disciplinary units. his nails are beyond the length and can be utilized as a weapon. >> i was like how dare you? >> stafford has been offered clippers several times now. today is his last chance to voluntarily trim his nails. >> stafford, how are you today sir? >> awesome. >> outstanding. remember we talked about those nails, sir, being within a quarter of the inch per regulation. let me see your nails. they're exceeding a quarter of an inch. in the policy.
2:33 am
mr. stafford i'm going to give you the clippers for you to cut your nails sir within a quarter of an inch after that i'll have to get sergeants to take care of it. and you also will receive extra sanctions for it. do you understand what i'm telling you, sir? all right i'm going to open this flap sir and give you the clippers. you're not going to do it? >> no. >> all right, sir, we'll take care of it okay. i'm going to have them come in and do it. thank you, sir. this is sheppard, i have inmate stafford in here and his nails are far beyond a quarter of an inch and i asked him to have his nails cut and he's refusing to do so and i'm asking for assistance to get that done.
2:34 am
>> the special operations program sends a three man team to stafford's cell to clip his nails for him. >> we're going to cut your nails, all right? >> not many times do we have to use force but sometimes it does happen. just as long as you're complying with the directives that i'm giving you. you can say what you want to say but as long as you're doing what i ask you to do. >> it's just one of those days. >> i can walk. i got this. >> there's no physical way you can make me cut my nails. primetime it's going down. >> how you going to cut them if i keep my fist balled up. >> you grabbing on me and squeezing on me.
2:35 am
>> all we've got to do is cut the fingernails. if you want to do it the hard way we can do it the hard way. >> you act like you don't want to harm me. look how you getting physical when you talk about you don't want to harm me. >> you willing to try to twist my arm while i'm in handcuffs. y'all not really making no sense right now. >> i feel something poking my skin right now. you got the taser right on me. can you get it off of me? >> with stafford's nails now at a compliant length the officers return him to his cell unsure of why when they might see hill next. >> i feel violated. i feel naked. just to keep from crying i'm going to laugh.
2:36 am
this isn't over. this is not over. >> stafford contemplates his next move, the segregation unit has a new arrival. 24 hours earlier josh gore was pulled off job as a kitchen worker after picking up a batch of dirty trays outside one of the female housing units. >> i don't know. i was just cleaning the trays doing my assigned job and seen a piece of paper. picked it up because it obviously wasn't trash and put it in my pocket and the officer asked me what i put in my pocket. >> the note was addressed to my love from wifey. gore says he has neither idea who either one could be but he did receive it outside of the housing unit of his girlfriend. >> i would grab it to help another inmate out. people write to women in the jail and stuff like that. so i just seen it.
2:37 am
oh, okay. >> if it comes through the postal service because it's legal mail it goes to the inmate we cannot stop it. but coming through from the food cart it's contraband. >> he facing the disciplinary committee to find out if he is assigned to segregation. >> you do understand the situation. >> am i wrong for picking up a piece piece of paper. what am i supposed to do? >> tell the truth. >> east been in here at least three times that i know of. he knows the rules but he's always trying to find ways around it. >> i never read it so i don't know who wrote it honestly. >> you just told me it was for you. >> i can assume it was. it's likely but do i know for sure? >> okay maybe i do but am i wrong? >> staff already confirmed she
2:38 am
wrote the note. >> i didn't tell them who i was writing and they were like who was it for? i said i don't know who it was for. >> since the violation is considered minor they confined her to her cell for six hours rather than sending her to the segregation unit. gore however could face up to 30 days because of his history of rule violations. >> unfortunately they charged him with possession of stolen property. that's why these guys need to make sure that they charge them with the right charge. it's his lucky day. >> it could be. >> just an oversight the officer should have paid a little bit closer attention. maybe the supervisors should have looked at it better. >> do you want to tell us what happened. >> there was a note on the tray. i picked it up. didn't even get to see where it came from. my girlfriend is in this jail. it's a possibility that was from my girlfriend. >> you knew there was a note there. >> no. i didn't know it was there coming, no. >> my girlfriend is in there.
2:39 am
did i know that was for me? >> it just seems strange to me that you're going through these trays that happen to come from this unit and you happen to find a note that was from your girlfriend. >> i've been going through a lot of trays. >> i understand that. but do you see what i'm say something. >> maybe i should have thrown it away. i'll accept accountability. >> your only saving grace in this report and the reason why you probably aren't going to receive much time is because you were charged wrong. if you were charged with possession of contraband we would have given you the 30 days. >> i want to say this though about that note thing, man, i utilize united states postal service to the fullest. check my mail log. it's on fire. i get a million letters a day from her. so i don't know if it was from me or what possessed her to do that because she knows that would jeopardize me.
2:40 am
>> thank you mr. gore. >> yes, sir. >> after deliberating the disciplinary committee decides that gore will not spend time in segregation due to the bad write up and he is sent back to his general population unit. >> i feel like i won trial or something it's crazy. >> hopefully i won't see you again any time soon. >> that's only because they messed up the paperwork. otherwise you would have been doing time. >> i know. >> all right. let's try to stay out of trouble. >> but gore did not get off without consequence. he has been fired from his kitchen job which means he can no longer catch glimpses of or pass notes to his girlfriend but gore says he'll find a way to get his job back. >> listen, i was found not guilty so i broke no rules. my whole life i've always been a person to manipulate my
2:41 am
surroundings. like make things work. >> i don't know i think he got fired but i'm not sure. we'll find out if he's here for dinner or not. i'll see him when he brings the tray ifs he comes. but if he doesn't come -- if i don't have a letter in the trays then i know he got fired. that's pretty much how that will work. >> adding to her stress is the suspicion that her friend jessica roberts identified her to officers as the author of the note. >> i didn't want to believe it at first because i didn't think, you know, that she would really straight throw me under the bus and let me get run over like that. >> samantha felt that i told on her and actually put it snitched on her. >> roberts acknowledges being questioned about the note but denies being the snitch. >> the sergeant was like i've already watched the camera now i want to know who has put the notes in the tray. she put two and two together. i didn't think nothing of it because i didn't snitch on her.
2:42 am
i just simply told them i didn't do it. >> she was like oh yeah. she did it. she writes her boyfriend in the kitchen. i came in here and did like sit ups for like two hours. my name wasn't on it. josh's name wasn't on it. nobody knew who was writing him but girls just i guess get jealous and decide to snitch people out. in jail you don't really have friends. >> coming up. >> she was swinging. i will give her that. >> jessica roberts comes under attack. and dewayne stafford gets welcome news.

confinement 23 hours a day for inmates that violate jail rules but here in charleston there's one aspect of segregation that makes it different from nearly all others. it houses both men and women. while women comprise about 10% of the total inmate population of 1300 relatively few get into serious trouble. >> we never have more than 3 to 5 females at a time. so to take up an entire housing unit for just females doesn't seem to make a lot of sense. >> just give it to me when you come out. >> we keep the females closest to the officers desk because they want to monitor the communication between the females and the males. sometimes you'll have a male or female that want to come to disciplinary so they can communicate. they have married couples and partners here and they try to speak to them through ventilation systems. >> what are you doing?
